R&D tax reliefs are valuable incentives encouraging companies to invest in science and technology innovations, boosting private sector funding and driving UK economic growth. To ensure these reliefs remain effective and cost-efficient, HMRC focuses on addressing non-compliance while ensuring that genuine claimants continue to benefit.

HMRC defines “non-compliance” and “error and fraud” to encompass a spectrum of behaviours, from unintentional mistakes and insufficient care to intentional violations. In the context of R&D reliefs, typical errors occur when companies claim ineligible costs, or the project itself is ineligible.

The most recent HMRC R&D Statistics on R&D claims was released in September. Following the implementation of policy and administrative changes aimed at reducing errors and fraud (outlined in section 2), there has been a decline in the number of claims submitted.

HMRC handles R&D tax claims through two main teams: ISBC (Individuals & Small Business Compliance) and WMBC (Wealthy & Midsized Business Compliance). Each team differs in its expertise and approach, leading to variations in how claims are managed and communicated. The WMBC team generally has a higher level of expertise and often takes a more measured approach, acknowledging areas for improvement in handling claims. This distinction can impact the tone and thoroughness of the enquiry process, depending on the team involved.

Measures introduced to reduce error and fraud: 

  • MREP (Mandatory Random Enquiry Program) annually to gauge levels leading to compliance checks:
    – MREP3 currently under way 2024/25
    – 20% of all claims under Compliance Check
    – 70-80% adjustment rate on Compliance Checks
  • Adjustments on SME rates to make less attractive 
  • Pre-notification 
  • Additional Information Form (AIF) making report compulsory 
  • Declaration of R&D agent used 
  • Merging the SME and RDEC schemes 
  • Consultation on raising Agent standards in progress 
  • Taxpayer Disclosure Facility by end 2024
